I. DEFINITIONS:
a. Student’s Residence
i. The student’s residence shall be that place where the student’s [parent/legal guardian spend at least four nights between Sunday and Friday.
ii. The student’s residence when the parents are separated, but not subject to a court entered custody order, or an order of shared parenting, shall be the parent’s home in which the student primarily lives.
iii. The student’s residence shall be the residence of the legal custodian/primary residential parent when a student is the subject of a custody order under Chapters 39 or 61, Florida Statues
iv. The student’s residence shall be the residence of the student’s legal guardian when the student’s parent(s) is physically or mentally unable to properly care for the student or because home conditions necessitate the student’s removal for protection.
II. MISLEADING OR FALSE EVIDENCE:
SECTION 837.06 FLORIDA STATUTES
Whoever knowingly makes a false statement in writing with the intent to mislead a public servant in performance of his official duty shall be guilty of a misdemeanor the second degree, punishable as provided in s. 442.083 or s775.084.
a. In addition to the criminal penalty associated with the making of false or misleading statement, if it is discovered that misleading or false evidence was presented in support of an application for an assignment, the student shall be reassigned immediately to the school within the appropriate geographic attendance area.
b. Failure to report a change in address shall be deemed evidence of intent to circumvent this policy and shall result in the application for an assignment being denied or revocation of the choice assignment.
a. Knowingly making any false statement on this application shall void acceptance to Palm Bay Academy. Any information determined to be false upon or after enrollment may be grounds for immediate dismissal from Palm Bay Academy.
b. The making of a false statement(s) on this application may subject the maker to criminal penalties under the laws of the state of Florida.
c. If your child is selected in the lottery, placement is not guaranteed in a specific grade, class, or with a specific teacher. Actual placement will be determined by the school’s ability to meet your child’s needs.
d. Promotion and retention decisions made by public schools will be honored when placing students in appropriate grade levels.
e. Requested information is kept confidential and will be used by the school for informational purposes only.
f. Parents and guardians hereby agree to abide by all policies and procedures. Parents are an important part of the programs at Palm Bay Academy; therefore, participation and a commitment to support Palm Bay Academy’s charter and mission is essential.
g. This is a NOT a registration form. Submitting an application does not imply or secure enrollment in Palm Bay Academy.
